RCW
11.88.008 defines a Professional Guardian as "a guardian
appointed under this chapter who is not a member of the incapacitated person's
family and who charges fees for carrying out the duties of court-appointed
guardian of three or more incapacitated persons." In order for a
professional Guardian to be appointed in a specific matter, RCW
11.88.020 allows appointment as guardian of an "individual
or guardianship service that meets any certification requirements established
by the administrator for the courts". The Washington Supreme Court has
authority to administer the courts.
On January 25, 2000 The Washington Supreme Court adopted General
Rule 23, which set out the requirements to qualify as a professional
Guardian. GR 23 also created the Certified Professional Guardian Board to
implement the requirements and to regulate the profession.
The Administrative Office of the Courts (AOC) operates under
the direction and supervision of the Chief Justice of the Supreme Court to
carry out the administrative functions of the Court. AOC staff are assigned to
assist the Certified Professional Guardian Board.
